Casselman Swimming Pool Enclosure Bylaw

The 2007-204 Swimming Pool Enclosure Bylaw requires that outdoor pools and spas have adequate enclosure for safety reasons.

The following is a summary of the bylaw. For precise wording and all provisions, please refer to the official 2007-204 Swimming Pool Enclosure Bylaw (PDF).

Key points

  • The bylaw applies to outdoor swimming pools and spas capable of retaining a water depth of 24 inches or more (600 mm), at any point.
  • Pools able to contain less than 24 inches of water at any point must be emptied after each use.
  • Before installing or building a pool or a spa, property owners must obtain a Swimming Pool and Enclosure Permit.
  • Swimming pool enclosures must be made of close-boarded, chain link or other approved material, with maximum openings of 4 inches, in order to keep children from accessing the fenced-in area.
  • The enclosure of in-ground pools must be at least 5 feet in height.
  • The enclosure of above ground pools or spas must be at least 4 feet in height.
  • Gates in the enclosures must be locked except when the pool area is used and supervised.
  • Decks and platforms for pools and spas must comply with the Ontario Building Code.

Enforcement

If an enclosure does not comply with the bylaw, the property owner will be notified and required to make corrections. If the property owner does not comply, corrective work may be ordered or the water may be removed from the pool at the owner’s expense.

Fines

Fines for violations are provided under the Provincial Offences Act.
